POST-SECONDARY SHELTER EXPENSE – READ IN CONJUNCTION WITH - FSD 34.06 and FSD 35– Education Travel Administration procedures may be found at: Part VII - Education Allowances - Post Secondary Education In Canada

1. Members are responsible for making schooling, education & family reunion travel arrangements and applicable payment on behalf of the student. Refunds must be returned to the Department of National Defence. Entitlement to Education Allowances is available from the date the member is posted, upon presentation of posting message, and may continue until the end of the last academic year that commenced while the member was serving abroad.

Full Time Post Secondary Student Shelter Cost

2. Post Secondary Dependent Student for purpose of family reunion travel, shelter allowance up to the school year of the 23rd birthday and up to two family reunion travel up to the school year of the 21st birthday, or one family reunion travel up to the school year of the 23rd birthday may apply to a student who normally resided with the member in Canada prior to posting outside Canada, and

  1. who is an unmarried child of the member or member's spouse; and,
  2. is in full time attendance in a post-secondary educational institution.

Post secondary education in Canada is not mandatory and can be obtained from (a) community colleges (non-degree granting) or (b) universities (degree granting). Education Allowance to assist with shelter cost that might not have occurred had the member remained in Canada, based on either (i) university, or (ii) college full-time attendance. An Education Allowance may only be provided for post secondary education in Canada while the member is on foreign assignment. In order to receive Post Secondary Shelter allowance, the member must submit documentation showing full-time attendance at Post Secondary Institution at the start/end of the school year or Documentation that outlines shelter expenses that will be paid during period of full-time attendance at post secondary institution in Canada.

When a member receives an Education Allowance on behalf of eligible dependents, all education expenses will be the responsibility of the member, including, but not limited to Shelter costs that might not have occurred had the member remained in Canada.

Post-secondary education
34.06
Subject to Section 34.02(d), the deputy head may authorize an allowance for actual costs incurred by an employee on behalf of a dependent student who has graduated from secondary school in Canada or has obtained equivalent educational status abroad for:
(a) shelter for the full academic year where the dependent student is in full-time attendance at a post-secondary educational institution in Canada which has been approved by the deputy head;
where reimbursement shall be limited to the annual maximum established by the Deputy Minister of Foreign Affairs, on the recommendation of the appropriate foreign service interdepartmental co-ordinating committee, on September 1st of each year, to reflect the cost of single occupancy on-campus residence at the University of Ottawa. In claiming shelter assistance, an employee shall provide evidence of actual costs and of full-time attendance until the end of the academic year. For periods of less than a complete academic year, the Deputy Minister of Foreign Affairs shall establish a daily rate on the basis of the annual maximum; and
(c) actual and reasonable commercial storage expenses, as determined by the deputy head, on the recommendation of the appropriate foreign service interdepartmental co-ordinating committee, for a dependent student's personal effects between consecutive school years.
Instructions
1. "Post-secondary education" means an education obtained from universities, community colleges and other related institutions in Canada.
2. The "academic year" referred to in Section 34.06 includes time for registration at the beginning of the term and for packing at the end of the term.
3. The provisions of this section do not apply to a student at the post secondary level in Canada where the employee's spouse or common-law partner has chosen not to accompany the employee on posting or the post secondary student is living with the other parent in Canada.
Interpretation of 34.06
Condition # 1: Dependent Student:
Member has to be accompanied at the post
FSD 2.01
(a) Accompanied by one dependant (accompagné d'une personne à charge) means that one dependant is residing with the employee at the post for at least 8 months of any consecutive 12-month period.
or
(b) Accompanied by two or more dependants (accompagné d'au moins deux personnes à charge) means that two or more dependants are residing with the employee at the post for at least 8 months of any consecutive 12-month period; one of such dependants must be a dependent child.
(k) Dependent means
(i) the spouse or common-law partner of an employee, or
(ii) a natural child, adopted child, stepchild or legal ward of an employee (or of an employee's spouse or common-law partner) who resides with the employee at the post, and
(A) is under 21 years of age and continues to be in a dependent relationship with the employee (or with the employee's spouse or common-law partner), or
(B) is 21 or more years of age, and is dependent upon the employee (or upon the employee's spouse or common-law partner) by reason of mental or physical disability;
(iii) subject to Section 2.01(aa) any other individual who resides with the employee at the post and who, in the opinion of the deputy head, is dependent upon the employee (or upon the employee's spouse or common-law partner) due to exceptional circumstances; where the deputy head exercises discretion under this section, the details shall be reported to the appropriate foreign service interdepartmental coordinating committee.
(l) Dependent student (élève ou étudiant à charge) except as provided for in FSD 51.02(c) means a dependant within the meaning of subsection 2.01(k)(ii) or (iii), who is not residing with the employee because that student is in full-time attendance at an educational institution.
Condition # 2: Secondary Graduate
Condition # 3: Full time student at post-secondary intuition in Canada
Condition #4: actual costs incurred by an employee. In cases of joint custody with the other parent resident in Canada, as per instruction #3: “The provisions of this section do not apply to a student at the post secondary level in Canada where the employee's spouse or common-law partner has chosen not to accompany the employee on posting or the post secondary student is living with the other parent in Canada.”. It is expected that “lodgings” will be with the other “joint custody parent” in Canada and that the member incurs no direct expense for lodgings.

FORM 17 POST SECONDARY SHELTER – APPLICABLE TO CANADIAN EDUCATION UP TO SY OF THE 23rd BIRTHDAY

APPROVAL By the Outside Canada Support Unit Approving Authority, within age parameters
PARAMETERS • Allowance available up to the school year of 23rd birthday.
• School year being 1 September to 31 August.
• Member must submit documentation showing dependent student’s full-time attendance at a Canadian Post Secondary Institution
• Member must initial declaration that this Post Secondary Shelter Allowance is being claimed on behalf of a natural child, adopted child, stepchild or legal ward on behalf of member or his/her spouses or common-law partner. Prior to member’s posting outside Canada, the student resided with member in Canada except when in full time attendance at an education institution in Canada. Because the student is attending an education institution in Canada as a full time student, thus the student is not residing on a full time basis with the member Outside Canada at the post.
INTENT To cover shelter costs only. Treasury Board sets annual allowance and age parameters.

STUDENT TERMINATES SCHOOLING/CEASES TO BE A FULL TIME STUDENT DURING THE ACADEMIC YEAR FOR WHICH AN EDUCATION GRANT HAS BEEN PAID

3. Contact DGCB/Dependent Education Management immediately when a dependent student terminates schooling/ceases to be a full time student during the academic year for which an education grant has been paid. Where pro-rating is determined to be the appropriate method of re-computation, a rate pro-rated by the month must be made payable to the Receiver General for Canada;

Prorate formula to determined used amount of Education Allowance

Education Allowance $_______ divided by 10 = $____________ times months of school attendance = $_______.
The unused portion: (total grant received minus Prorate formula amount) would be the portion reimbursed to the Receiver General of Canada.

College and University Application Fees and Academic Course Evaluation Fees

4. Education Allowance for College and University application fees and academic course evaluation fees which are in excess of those paid by students residing in Ontario, where such costs are incurred while attending the final year of secondary schooling within 12 months of graduation from a secondary level educational institution.
